Will and Testament of Rebecca Danley In the name of God, Amen: I, Rebecca Danley of Greene County Arkansas as being in good bodily health and sound disposing mind and memory calling to mind the frailty and uncertainty of human life and being desirous of settling my worldly affairs and directing the Estate’s-with-it has pleased God to bless me-shall be disposed of after my decease while I have strength and capacity to do so, do make and publish this my last will and testament. And first I commend my immortal being to him who gave it and my body to the earth to be buried with little expense and ostentation by my Executor here and after named. And as to my worldly estate and all the property real personal and mixed of which I shall die seized and possessed or to which I shall be entitled at the time of my decease. I advise bequeath and dispose of in the manner following to wit: My will is that all my just debt and funeral charges shall be paid out of my Estate by my Executor hereinafter named as soon after my decease as shall by him be found convenient. I give devise and bequeath to my beloved dauthter Elizabeth Martin daughter of Thomas Danley and Rebecca Danley the South West quarter of Section Twenty four in Township fourteen North of Range four East containing forty acres to be delivered to her or her bodily heirs by my Executor hereinafter named to have and to hold of the same to her and her bodily heirs and assigns forever. I give devise and bequeath to my beloved son Atlas A. Danley, all my right to an improvement on the North East quarter of Section Twenty five in Township Seventeen North of Range four East one iron gray horse and also fifty Dollars in money to be paid to him by my Executor hereinafter named within thirth days after my decease to have and to hold the same to him and his legal heirs at law forever. I give devise and bequeath to my beloved Daughter Francy Bowling the South East quarter of the South West quarter of Section Twenty four in Township Seventeen North of Range four East containing forty acres. One Iron Gray horse named Carter to be delivered to her by my Executor hereinafter named after my decease to have and to hold the same to her and her bodily heirs and assigns forever. All the rest and residue of my estate real personal or mixed of which I shall die seized and possessed or to which I shall be entitled at the time of my decease I give devise and bequeath to be equally divided to and among my three children Elizabeth Martin, Atlas A. Danley and Francy Bowling. Lastly, I do nominate and appoint my son-in-law, Nathaniel M. Bowling to be my Executor of this my last Will and Testament. In testimony whereof I the said Rebecca Danley have to this my last Will and Testament contained on these two sheets of paper and to every sheet thereof subscribed my name and to this the last sheet thereof I have hereunto subscribed my name and affixed my seal this 18th day of February AD 1864. Signed, Sealed, Published and Declared by the said Rebecca Danley, as and for her last Will and Testament in presence of us who at her request and in her presence and in the presence of each other have subscribed our names as witnesses.

Letters of Testamentary State of Arkansas Be it remembered that on this ninth day of December AD 1867 before the undersigned Clerk of the Circuit Court and exofficio Clerk of the Court of Probate,for Greene County (in vacation of said Court of Probate) personally appeard A. T. Ragan, one of the subscribing witnesses to the foregoing and assumed will of Rebecca Danley, Dc,d, who after being duly sworn by me disposes as follows: "I was well acquainted with the Testator Rebecca Danley, and was called on by her at her residence in Greene County to witness the said assumed will together with J. P. Harris (who is since that time departed this life) on the day said will bears date that the said J. P. Harris signed the said Rebecca Danley’s name thereto and that she made her mark to said will in our presence and I sealed and published said will as her last will and testament and called on us to sign the same as witnesses which we did in her presence and in the presence of each other, that said Testator was of sound and disposing mind and memory." "I further state that the other witness J. P. Harris is now dead, that I saw him sign the testators name to said will that the testaror requested his to do so. And also at the time and place comes H. W. Glasscock, who after being duly sworn deposes and says that he was well acquainted with the handwriting of J. P. Harris and that the signature to the annesed and foregoing purporting to be his he believes to be the handwriting of the said J. P. Harris." A. T. Ragan, H.W. State of Arkansas I R. W. Gardner, Clerk of the Circuit Court and Exofficio Clerk of the Court of Probate herebe certify that the foregoing will was filed in my office on the 9th day of December that the same with the proof thereof is now duly recorded in Deed Book "C" pages 39,40 and 41. State of Arkansas To all persons to whom these presents shall come Greeting: Know ye that the Last Will and Testament of Rebecca Danley late of Greene County deceased hath in due form of law been exhibited, proved and recorded in the office of the Clerk of the Court of Probate for Greene County a copy of which is herewith annesed and inasmuch as it appears that Nathaniel M. Bowling has been appointed executor, the same and to the end that the property of testator may be preserved for those who shall appear to have a legal right or interest therein and that the said Will may be executed according to the request of the Testator, we do hereby authorize him the said Nathaniel M. Bowling as such Executor to collect and secure all and singular the goods and chattels rights and credits which were of the said Rebecca Danley at the time of her death in whosoever hands or possession the same may be found and to perform and fulfill all such duties as may be informed upon him by the said Will so far as there shall be property and the law charge him, and in general to do and perform all other acts which now are or hereafter may be required of him by law. In testimony whereof, I, R. W. Gardner, Clerk of the Circuit Court and exofficio Clerk of the Court of Probate in and for said County of Greene have hereunto set my hand and private seal, having no seal of office or my office in Gamisville this 18th day of December AD 1867.
